On what terms we use third-party brands

We use third-party brands within the limits permitted by law, in a fair and non-misleading manner.

Ownership of trademarks

  1. All trade names, brands, logos and trademarks mentioned on the website are the property of their respective owners and are protected by trademark law and intellectual property law.
  2. In particular, the name Manheim and the associated logos are registered trademarks of Cox Automotive, Inc. and have been used on the website solely for informational purposes.
  3. The use of a trademark on the website does not transfer any rights to that mark to AUTOMAX, NEXTCAR-USA or the User.

Nominative (informational) use

  1. Third-party brands are used in their so-called nominative function — that is, to indicate a specific product, service or source of data (e.g., a Carfax report, a listing from a Manheim auction, an MMR valuation), and not to designate AUTOMAX's own services.
  2. We limit such use to the extent necessary to convey information and avoid implying any official affiliation, sponsorship or authorization by the owner of the brand where no such relationship exists.
  3. We do not modify third-party marks in a way that could be misleading, nor do we exploit their reputation to gain an unfair advantage.
